This is done through the courts. All requirements for the claim, as well as the list of documents necessary to present to the court, are provided for in Articles No. 131 and No. 132 of the Civil Procedure Code. The application must be submitted in writing. It must indicate:

In accordance with the Code of Administrative Offenses (Article 19.15), a person who does not take care of timely registration of registration is subject to a fine, the amount of which can reach 5,000 rubles.

In practice, everything is even more complicated. The applicant comes for an interview, during which it turns out that he does not have a residence permit. What does a competent employer do? He reports to the Federal Migration Service that this person has violated the registration rules. Since applicants often provide information about themselves in advance, even before arriving for an interview, representatives of the Federal Migration Service quickly find them and forcefully hold them accountable.

There is another consequence. And it lies in the small amount of the future pension. If a person does not have registration, then he cannot make tax payments. Therefore, it is in his own interests to make a temporary registration.

By the way, the likelihood that the employer will inform the Federal Migration Service is quite high. If he does not employ a person without registration, he will violate Articles 64 and 65 of the Labor Code of the Russian Federation, and will also be held accountable under Art. 5.27 of the Code of Administrative Offences. Therefore, he will prefer to report the observed violation to the Federal Migration Service. Of course, there is a certain paradox in these provisions, but such are labor disputes and their specificity.

What else should you know?

A person wondering whether registration is required when applying for a job would do well to inquire about what benefits he might be missing out on by finding a place where registration is not required.

Firstly, having a documented place of residence, he is guaranteed to receive an official position. “Secondly” follows from this, implying regularly paid salaries, vacation and sick pay, the availability of insurance and regulated days off. Thirdly, it will be registered with the local Pension Fund. All this will give a person the opportunity to pay taxes. Which, in turn, guarantees the absence of problems with the bodies representing the law.

Other pitfalls

This is not all that can be said about whether it is possible to get a job without registration. It is important to note other cases.

So, for example, if a person is registered in the Moscow region, then upon arrival in the capital he does not need to obtain a temporary residence permit there.

Foreigners, in turn, in addition to obtaining a work permit, will need to register temporarily, and do this within 7 days after the day on which their work activity began.

Residents of Belarus and Kazakhstan are subject to different deadlines as these countries are members of the Customs Union. They are allowed to register within 30 days after arriving in the capital.

In cases where a person has a job in another city without registration, he can be calm until representatives of the Federal Migration Service visit the enterprise with an inspection. Then he, like the employer, will have to face some troubles associated with violation of the law.

Possible vacancies

Continuing the somewhat controversial topic regarding whether people without registration will be hired, I would like to note the positions that are most often occupied by people without registration.

Typically these are taxi drivers, real estate agents, telephone order takers, personal drivers, painters, builders, repairmen, printers, packers, cleaners, and service personnel.

About work in Moscow

I would like to say a few more words about employment in the capital of our country. Many people are interested in working in Moscow. Without registration (local, of course) it is very difficult to get one. If you pay attention to the advertisements, you will notice that in every second one, in the paragraph “Requirements for the applicant,” the presence of registration in Moscow or Moscow Region is noted. And employers, approached by people who do not have it, often turn to the Federal Migration Service with a complaint about their violation of the notorious provisions of the law.

However, Article 19.15 has an important note noted in its second part. It says that a person staying in the capital without registration is exempt from administrative liability imposed for its absence. But with only one amendment. This note applies to people staying in residential premises (apartment, house, townhouse, etc.).

Documents to be presented upon employment

Finally, it is worth identifying the list of documents that the applicant must submit when applying for a job. Here's what it includes:

  • Passport or other document confirming the identity of a citizen.
  • Employment history. But this is only if hiring is carried out for the first time. A person who officially has no experience is issued a work book by the employer.
  • SNILS.
  • Document on receipt of education.
  • For men - military ID.

Some employers do not require compliance with the penultimate paragraph. But this nuance depends on the specifics of the enterprise and its activities. Otherwise, there are no exceptions.
