And what about the expediency of conducting cash payments? After all, an entrepreneur will have to conclude transactions with other legal entities / individual entrepreneurs, pay salaries, pay for various services and works, keep funds, transfer taxes and fees, and if retail accept plastic cards from buyers. And here the issue of trust has not yet been touched upon, the level of which on the part of reputable partners increases "many times" in the presence of a bank account.

It turns out that after all, a current account is more a necessity than a whim. How is the opening process carried out?

Before entering into an agreement with financial institution, check out the reliability ratings. Then evaluate the territorial location of the bank, calculate the annual amount of service. Many banks today have developed software by the type of "Client-Bank", the presence of which significantly increases the efficiency and security of settlements.

What financial factors should be considered:

  • The cost of opening an account and subsequent maintenance (by type of operation).
  • The amount of commission for cash withdrawal.
  • Availability and size of subscription fee.
  • Internet banking fees.
  • Salary projects and tariffs.
  • Terms of loans for MB, including overdrafts for individual entrepreneurs.
  • Operating day length.
  • Availability of various electronic services.
  • Location of terminals and ATMs.

Refusal to open a bank account

As a rule, entrepreneurs do not have problems with opening accounts. However, in some cases, a citizen may receive a justified refusal. The reason is the incorrect filling of the documentation, the execution of overdue forms, the submission of an incomplete set of forms. If an individual believes that the refusal was made without good reason, it is recommended to request an explanation in writing from the bank for further appeal to the judicial authorities.

How can an individual entrepreneur invoice an LLC?

Mutual settlements between an LLC and an individual entrepreneur must be carried out in compliance with the accepted legal regulations. At the same time, although entrepreneurs have the right to keep simplified accounting and are not required to draw up most forms provided for legal entities, in relation to transactions with counterparties, it is recommended to adhere to general rules. In particular, it is desirable to conclude in writing contracts for the sale of products, as well as the provision various works. In order to obtain the basis for the transfer of funds, an invoice is issued for payment.

The document is issued for payment by the IP buyer of the full or partial amount for any services or goods. In the second case we are talking about an advance, that is, an advance payment. If the conditions specified in the contract change, the invoice for payment must also be reissued. Account details include:

  • Name of the parties to the contract (seller-IP and buyer).
  • Invoice number and date.
  • Full details of the entrepreneur - information must be specified correctly in order to ensure the prompt transfer of funds to the destination.
  • A list of goods or services sold - indicating the names, quantities, relevant units of measurement, unit price and total cost. The amount of VAT is allocated if the situation provides for the calculation of tax.
  • Payment terms - if any.

The entrepreneur himself signs the document, the seal is affixed at will. If an individual entrepreneur is not a VAT payer, for example, due to the use of special modes, an entry “Without VAT” is made on the account.

Personal account of an individual entrepreneur - consequences of use

Often, a businessman, in addition to a bank account, has a regular current account registered in the name of a citizen. Can this account be used for business purposes? After all, according to paragraph 2 of Art. 11 Settlement accounts include any accounts opened with banks on the terms of an agreement. However, Instruction 28-I of September 14, 2006, namely the provisions of clause 2.2, obliges individuals to open accounts in order to carry out those operations that are in no way related to entrepreneurship.

On the basis of clause 2.3 of the Instruction for doing business by legal entities and individual entrepreneurs, current accounts are opened with the provision of the relevant registration documents to the servicing bank. Consequently, entrepreneurs cannot use a personal account in the financial and economic activities of a business, as this is a violation of legal requirements. However, the tax authorities allow such operations, but with the obligatory condition of informing the IFTS about the use of an individual's account (Letter No. ED-3-3 / [email protected] from 06.03.13). There are currently no penalties for misuse of a personal account.
