From January 2019, state employees will receive 6% more. The salaries of teachers, doctors, scientists and social workers will increase - all of whom were discussed in the presidential May decrees. Since 2012, the salaries of state employees have been regularly raised, but even in 2019 they will not reach the planned targets of 100 and 200% of the average income in the regions.

State employees are customarily called all people whose work is paid from the state or municipal budget. However, by law, all recipients of state allowance are clearly divided into:

  • state employees;
  • civil servants;
  • law enforcement officers.

Therefore, when the government promises a salary increase for state employees in 2019, we are talking, first of all, about the categories that fall under the May presidential decrees, namely about workers in certain areas:

  • medical;
  • social;
  • scientific;
  • cultural.

The level of income of state employees has always lagged far behind the average salary of Russians. In order to eliminate this imbalance and attract young professionals to the educational and medical sphere, Russian President Putin V.V. in 2012 instructed to bring the incomes of state employees to an acceptable level, namely to increase to the level of:

  • not lower than 100% of the income in the region of the salary of teachers, kindergarten teachers, medical secondary and junior staff, social workers and cultural workers;
  • 200% of regional salaries income of higher education teachers educational institutions, doctors and scientists.

The salaries of state employees should have increased to the specified level by 2018.

Already at the beginning of 2018, it was clear that the salaries of employees public sector, despite the annual increase in salaries, did not reach the planned targets. The growth of the minimum wage and the average wage of Russians outstripped the planned indicators of the program for the gradual improvement of wages in state (municipal) institutions in 2012–2018.

Therefore, in May 2018, the President of the country clearly indicated whether there would be an increase in the salaries of state employees. The program for improving wages continues to operate until the indicators are brought to the planned figures, that is, wages in the public sector will continue to grow, including in 2019.

By how much will the salaries of state employees be increased

The growth of wages of certain categories of public sector employees who fall under the May decrees is included in the federal budget. The project states that the nominal increase in 2019 will be 6% of the wages of the previous year.

A further increase in the wages of state employees is also planned:

  • in 2020 - by 5.4%;
  • in 2021 - by 6.6%.

However, the salaries of teachers and doctors are tied to the level of regional incomes. Therefore, bringing their income to the proper level is a priority goal for local budgets. It is the regions that should look for opportunities for an additional increase in the salaries of state employees.

Terms of increase

The salaries of state employees will increase from January 1, 2019. The news circulating on the network about the postponement of deadlines to October does not correspond to reality.   • employees of cultural institutions - 40,500 rubles;
  • scientists - 102,000 rubles.

Many doctors, teachers, employees of cultural institutions are worried that their income will remain at the same level, and the increase in salary will only cover the amount of bonuses that they will be deprived of. The state encourages employers to constantly increase the wages of employees. Raising salaries comes in several ways. First, by increasing the indicators of the federal and regional minimum wages. Secondly, by applying mandatory indexation. Finally, by agreement between employers and employees. But are employers obliged to apply all these salary increase mechanisms or can they legally save money? We tell.

Salary - not less than the minimum wage

The Labor Code of the Russian Federation establishes a guaranteed minimum wage for which any employee is entitled to apply. In accordance with Art. 133 of the Labor Code of the Russian Federation, the monthly salary of an employee who has fully worked out the prescribed norm of working hours during this period cannot be lower than the minimum wage (minimum wage).

The minimum wage is set simultaneously throughout the territory of the Russian Federation federal law and is mandatory for all organizations and individual entrepreneurs using a hired labor force. The minimum wage is regulated by Art. 1 of the Federal Law of June 19, 2000 No. 82-FZ “On the Minimum Wage”. According to this norm, the minimum wage in the Russian Federation is currently 7,800 rubles per month.

The next increase in this value is scheduled for January 1, 2018 as part of a phased increase in the minimum wage to the subsistence level (and recommended for adoption).

From January 1, 2018, the minimum wage will be raised to 85% of the subsistence level and will amount to 9,489 rubles per month.

Accordingly, from January 1, 2018, an employer who pays his employees the minimum wage is obliged to increase it to new values. To do this, you need to issue an order to amend the staffing. This can be done both by approving a new annex to the schedule, and by adopting a new staffing table.

Speaking of a salary “not lower than the minimum wage”, they always mean payments under an employment contract, and not under a civil law contract. When engaging employees on the basis of a work contract or paid services, the employer may not comply with the terms of the minimum wage. Accordingly, an increase in this indicator does not lead to the obligation of the employer to increase the amount of remuneration under GPC agreements.

In addition, in a number of cases, directly specified in the Labor Code of the Russian Federation, the employer is also not required to adhere to the minimum wage. This, for example, part-time work (Article 93 of the Labor Code of the Russian Federation) and part-time work (Article 284 of the Labor Code of the Russian Federation). In relation to such employees, the employer is not obliged to draw up any additional agreements in connection with the increase in the minimum wage.

In all other cases that are not directly specified in the Labor Code of the Russian Federation, employers cannot pay their employees wages below the minimum wage. Otherwise, they may be held liable under Art. 5.27 of the Code of Administrative Offenses of the Russian Federation. The fine for paying wages below the minimum wage for legal entities ranges from 30,000 to 50,000 rubles. Repeated violation will increase the fine to 70,000 rubles.

Mandatory salary indexation

In accordance with Art. 134 of the Labor Code of the Russian Federation, employers must index wages in connection with an increase in consumer prices for goods and services. According to this rule, government bodies, organs local government, as well as institutions, index wages in the manner prescribed by labor law. All other employers - in the manner prescribed by the collective agreement and local regulations.

Norm Art. 134 of the Labor Code of the Russian Federation, as we can see, is vague and does not establish a clear procedure for indexing the salaries of employees of commercial companies. In this regard, many employers have a delusion that salary indexation is mandatory only for government agencies and institutions. Actually it is not. Salary indexation is mandatory for all employers, but with some reservations.

The Constitutional Court of the Russian Federation, in Ruling No. 2618-O of November 19, 2015, noted that the Labor Code of the Russian Federation does not allow an employer who is not related to the public sector to evade wage indexation. Indexation is aimed at ensuring an increase in the level of the real content of wages, its purchasing power. By its legal nature, indexation is a state guarantee for the remuneration of employees and must be provided to all persons working under an employment contract.

At the same time, the legislation does not establish a clear amount of indexation. Therefore, the amount of indexation is determined at the discretion of the employer, taking into account the opinion of the trade union. The employer is not required to apply the official inflation rate. Any increase in wages due to rising consumer prices is considered indexation. For documenting indexing employment contracts are not reviewed. Indexation is carried out on the basis of the order on indexation of salaries.

Meanwhile, there is one caveat. The indexation procedure must be clearly spelled out when concluding a collective agreement or fixed in a local normative act taken with the union's opinion in mind. Only in this case, the employer must index. Without establishing an indexation procedure in local acts, the employer is not obliged to increase the salary of its employees.

A similar opinion was expressed by the Constitutional Court in Ruling No. 1707-O of July 17, 2014.

Therefore, if the procedure for indexing wages was enshrined in a collective agreement or any other local act, the employer is in any case obliged to index the wages of his employees. Therefore, when concluding collective agreements, this circumstance should be taken into account.

If the employer does not have financial opportunities for regular salary increases, it is better to exclude any mention of indexation from the text of labor, collective agreements and local acts.

Please note that recently Rostrud gave clarifications regarding the indexation of salaries in commercial organizations. From the point of view of the department, employers are in any case obliged to index wages due to inflation. The procedure for such indexation must be fixed in a collective agreement or other local act.

At the same time, Rostrud requires fines for employers who do not index wages due to inflation. Moreover, regardless of whether the organization has adopted a local act on the indexation of salaries, or not.

This position is, to put it mildly, controversial, since Art. 134 of the Labor Code of the Russian Federation does not directly establish the obligation of employers to adopt local acts on wage indexation. Be that as it may, such clarifications may provoke a wave of fines under Part 1 of Art. 5.27 of the Code of Administrative Offenses of the Russian Federation (fine up to 50 thousand rubles) and litigation.

Application of the regional minimum wage

Along with the federal minimum wage, each Russian region has its own minimum wage indicator. Moreover, as a rule, the regional minimum wage is much higher than the federal one. For example, the minimum wage in Moscow is now 18,742 rubles (Decree of the Government of Moscow on September 12, 2017 No. 663-PP).

The procedure for establishing regional indicators of the minimum wage is regulated by Art. 133.1 of the Labor Code of the Russian Federation. The specific value of the regional minimum wage is approved and regularly updated based on the regional minimum wage agreement. The agreement is developed and adopted by the tripartite commission for the regulation of social and labor relations of the corresponding subject of the Russian Federation.

Employers are considered to have automatically acceded to the agreement on the regional minimum wage after 30 days from the date of the official publication of the proposal to join such an agreement. No written consent from employers is required.

After 30 calendar days after the publication of the proposal, employers are required to apply the regional minimum wage. Payment of wages below the specified value is considered a violation under Part 1 of Art. 5.27 of the Code of Administrative Offenses of the Russian Federation. Recall that the fine for organizations under this rule is up to 50,000 rubles.

At the same time, organizations have a completely legal opportunity not to apply the regional minimum wage. To do this, they must draw up a written refusal to join the regional minimum wage agreement. The refusal must be sent to the tripartite commission for the regulation of social and labor relations of the relevant subject of the Russian Federation no later than 30 calendar days from the date of publication of the agreement and proposal to join it.

At the same time, the protocol of consultations with the trade union organization and proposals on the timing of raising the salaries of employees to the size of the regional minimum wage (Article 133.1 of the Labor Code of the Russian Federation) will need to be attached to the refusal. In the minutes, the trade union seems to agree that at present the employer cannot raise wages to the regional minimum wage. At the same time, the estimated dates for the transition to the regional minimum wage are indicated, which are not mandatory, but by indicating them, the employer does not refuse the regional minimum wage in the future.

Why do employers refuse the regional minimum wage, you ask? It's very simple - the rejection of the regional minimum wage provides an opportunity to save on the wage fund. No liability for such refusal is provided by law.

However, it should be borne in mind that the payment of wages below the regional "minimum wage" gives the controlling departments an additional reason to tighten control over such an employer. According to the logic of the inspectors, if employees agree to work in an organization with a salary below the average for the region, then we can talk about gray schemes for paying salaries in envelopes and tax evasion.

Most of the people in our country are employed, with the exception of a small number of people who are self-employed or other types of business. Given that the prices of food, clothing, gasoline and utility bills are constantly rising, the issue of increasing income is becoming increasingly important. For working citizens, it is important to know who and in what amount will receive a salary increase in 2019.

What is the reason for the increase

Inflation every year depreciates the existing exchange rate of the national currency by several percent. According to official data, in 2017 inflation was approximately 2.8%, in 2018 - 3.1%, but in reality, the expenses of Russians grew much more. If we take into account the increased VAT and other burden on small businesses, which will affect price growth, the purchasing power of citizens in 2019 will decrease by at least 5-7%.

Private organizations have their own systems for calculating salaries and increasing them, which are not regulated from the outside. On the other hand, the amount of salaries in institutions financed from the state treasury is controlled by law. According to Art. 134 Labor Code RF, wages should rise in line with the rise in prices for goods and services.

In addition to the instructions of the Labor Code of the Russian Federation, the government of the Russian Federation is striving to fulfill the May instructions of the President, which dictated an increase in payments to certain categories. Draft budget

The amount of salaries of workers is approved in advance in the budget of the Russian Federation. Draft Federal Law No. 556362-7 “On federal budget for 2019 and for the planning period of 2020 and 2021” was approved in the first reading. In accordance with it, wage indexation is planned. In addition, the minimum wage, which determines the minimum monetary allowance, will be 11,280 rubles from January 1, 2019. (this is an average figure that differs by region). Although its increase in the current period is very insignificant, in May 2018 this target was raised immediately by 17%, which significantly affected the growth of wages for many employees.

Who gets a pay rise

Salaries are paid from the state and municipal budget different categories workers. These are law enforcement agencies (the army, law enforcement agencies, bailiffs, the Federal Penitentiary Service, etc.), civil servants, tax and judicial authorities. They also include those who are traditionally called "state employees": doctors and health workers, teachers and educators, researchers, cultural workers, social services.

Important: according to the existing draft budget, salary increases are planned in different equivalents. To a greater extent, salaries will increase for workers in those areas that were noted in the May decree of the President.

Employees of the state apparatus receive not only good financial support from the treasury, but also have various benefits and privileges. Therefore, the expected increase in their salaries is perceived by society rather painfully. The salaries of civil servants, which were low in the 2000s, have increased sixfold since then - a gradual increase took place until 2013, then it was suspended. In 2019, the salaries of officials will be indexed by 4.3%. This is a forced measure, correlated with the level of inflation. Most likely, indexation will occur in the first quarter.

The salary of this category of workers consists of many components, which include length of service, the plan carried out by the unit and the personal effectiveness of the employee. It is expected that the average monthly income of an official in 2019 will be about 136 thousand rubles, which is several times higher than the total average monthly income in Russia. However, this figure is an average indicator - if the heads of departments receive about 200 thousand, then a young employee who comes without experience can count on only 20-25 thousand rubles. per month. In addition, this includes not only the salary part, but also all bonus and incentive surcharges. It is planned that the scheme of their calculation will change - first of all, the rank and position, as well as the fulfillment of all labor standards, will be taken into account.

Among those who will receive a salary increase in 2019, workers in the medical, educational, scientific and cultural fields stand out. The draft budget regulates the increase in the rate of their salaries by 6% in 2019. In addition, it is planned to change the system for calculating cash security. So, the tariff scale, which included 27 categories, is canceled. The new tariff scheme will include 17 tariffs defining professional and qualification categories. The current system will also be reviewed. federal allowances that form at least a third of the total annual income of medical and educational institutions- they will not be distributed centrally, as before, but in accordance with the orders of regional ministries and departments.

According to statistics, over the past 5 years, educational workers began to receive almost 2 times more, as well as workers in medicine. However, in fact, it turns out that this increase is nominal - it was achieved through staff reductions, the merger of universities and hospitals, and reductions in seniority bonuses and qualifying degrees.

Law enforcement agencies

The salaries of employees of the Ministry of Internal Affairs, the army, the Ministry of Emergency Situations, the FSSP and the Federal Penitentiary Service will increase by 4.3% according to the draft federal budget. The increase will take place in October 2019 and will be necessary measure- over the past few years, the payments of the “siloviki” have not been indexed, with the exception of 2018. Against the backdrop of inflation, their salaries have depreciated by 30-40% over the past 5 years.

The May decree of the President also affected the remuneration of employees of law enforcement agencies. So, by 2024, police officers should receive a salary of at least 150% of the average income in the region. However, this increase will take place in stages. In addition, it provides for an increase in wages and service personnel:

  • infrastructure engineers;
  • those responsible for the technical part of maintaining buildings in working condition (ie electricians, plumbers, technologists);
  • system administrators and specialists in maintenance of software and hardware systems;
  • cleaning specialists.

In accordance with the previously announced decrees, the salaries of doctors, military, police, and teachers will also be increased. At the same time, teacher salaries may soon begin to be calculated in a new way.
